Terms & Conditions

1. Definitions

For the purposes of these Terms & Conditions, the following definitions apply:

  • “Affiliate”: An individual or entity accepted into the XTRD Affiliate Program and authorised to promote XTRONGHOLD products in exchange for commissions.
  • “Commission”: Compensation paid to the Affiliate based on confirmed sales generated through the Affiliate’s unique tracking links.
  • “Program”: Refers to the XTRD Affiliate Program managed by XTRONGHOLD.
  • “Revenue Confirmation Duration”: The period during which a sale is subject to review and will not be locked until 60 days following the transaction date.
  • “Referral Program”: Any program associated with XTRONGHOLD that allows Affiliates to earn commissions for referring customers through a unique set of links.
  • “Platform”: The online interface and tools made available to Affiliates to manage their participation in the XTRD Affiliate Program.

2. Introduction

Welcome to the XTRD Affiliate Program! By joining our program, you agree to abide by the following terms and conditions. Please read them carefully.

3. Company Information

4. Eligibility

To participate in the XTRD Affiliate Program, you must:

  • Be at least [insert minimum age, e.g., 18 years old].
  • Provide accurate information during the application process.
  • Comply with all applicable laws and regulations.

5. Commission Structure

Affiliates will earn commissions based on sales generated through their unique affiliate links. Commission structures may vary and will be outlined in the affiliate dashboard.

6. Account Approval and Suspension

  • Applicants will receive notifications regarding their application status.
  • Affiliates may be suspended or banned for violations of our policies, including:
  • Making deceitful promises or misleading claims.
  • Non-compliance with program policies and guidelines.
  • Using unacceptable promotional practices.
  • Engagement in activities deemed unethical or harmful to our brand.
  • Suspensions are in effect for at least 40 days and may be extended at the company’s discretion. During this time, affiliates will not earn commissions.
  • Upon reinstatement, affiliates will start from a zero balance. Any attempts to circumvent this by creating new accounts may result in permanent bans.

7. Access to the Platform

XTRONGHOLD GmbH and its affiliates do not guarantee that the functions contained in the Platform will be uninterrupted or error-free or that defects will be corrected. We may suspend, withdraw, discontinue, or modify all or any part of the Platform without notice.

8. Payment of Commissions

  • Commissions will be calculated based on approved sales and will not be paid during any suspension periods.
  • Payments will be made via direct bank transfer or PayPal payouts. All sales will remain in a “sales pending period” and will not lock until 60 days following the date of transaction. Payments will be issued on the 20th of the month following the Revenue Confirmation Duration. For example, if a transaction occurs on April 1, it will lock on May 31, and payment will be made on June 20.

9. Commissionable Products

XTRONGHOLD GmbH specifies that certain products may not be eligible for commissions:

  • Gift cards are non-commissionable, and all sales of gift cards will be voided.
  • XTRONGHOLD reserves the right to exclude commissions on products deemed as key product launches, discontinued partnerships, or any other reason XTRONGHOLD finds that a product should no longer be commissionable.
  • In the event of a key product launch, text links and banners will not be provided for these products within the affiliate network. Any affiliate found attempting to promote these launches with affiliate links will have their commissions voided and may face potential removal from the program.
  • If a previously commissionable product is no longer eligible for commission, all banners and text links for that product will be removed from the network, SKUs will be set to 0% commission, and affiliates will receive notification about the commission update.
  • Commissions are only valid for purchases made on XTRONGHOLD’s official website and exclude purchases made through other channels.

10. Coupon Guidelines

If you are enrolled in our Program and your Website promotes coupon codes, you must adhere to our Coupon Guidelines as follows:

  1. You may ONLY advertise coupon codes that are provided to you through the affiliate program or network or that are displayed on our website(s).
  2. Posting any information about how to work around the requirements of a coupon/promotion (e.g., first-time customers only) will result in removal from the program.
  3. Coupons must be displayed in their entirety with the full offer, valid expiration date, and code.
  4. You may NOT use any technology that covers up the coupon code and generates the affiliate click by revealing the code(s).
  5. You may NOT advertise coupon codes obtained from our non-affiliate advertising, customer emails, paid search, or any other campaign.
  6. You may NOT suggest that any ongoing offer requires clicking from your website to redeem. For example, if all items on the site have free shipping over $100, you may not imply that the customer must click from your site to get this deal.
  7. Additionally, if your website ranks on the first page of Google for terms related to our website or company name(s) combined with the words coupon, coupons, coupon code, promo code, etc., and/or your conversion rate exceeds 25%, you may be offered a lower commission than our standard rate to offset the reduced profitability of orders. The current rate is 2%.

11. Coupon Attribution & Authentication

Affiliates whose primary business is posting coupons, who are viewed by the program as being a coupon site, and/or who are tagged as coupons in our system may not be paid commissions for sales generated without a corresponding valid coupon code. Valid codes are defined as codes that are made available to the affiliate channel in general through newsletters or the My Offers Database. Sometimes, coupon affiliates may only be paid on codes provided during secured paid placement promotional windows and not on any codes outside that window. Coupon codes that are not real , expired, not specific (e.g., up to 40% off sale items), or are long-term sitewide offers that do not require a code may not be considered valid codes, and the affiliate will not be given a commission on these orders. All placements secured with affiliates will require an exclusive code and/or link that will be provided. Transactions outside of that code/link will not be credited to the affiliate.

12. Sub-Affiliate Networks

Promoting XTRONGHOLD through a sub-affiliate network is permitted; however, you must be completely transparent regarding where traffic from your sub-affiliates originated. Sub-affiliate networks must ensure that all sub-affiliates promoting the XTRONGHOLD program adhere to our program terms and conditions. This includes restrictions on advertising through toolbars, browser extensions, and paid placements such as pay-per-click campaigns. Sub-affiliate networks must also receive approval prior to allowing any coupon sub-affiliate to promote the XTRONGHOLD program. Failure to comply with our sub-affiliate network terms may result in a loss and/or reduction of commission from sales made through any sub-affiliate that does not comply with our program terms.

13. Domain Names

Using any of our trademarked terms as part of the domain or sub-domain for your website is strictly prohibited (e.g., xtronghold.website.com or www.xtronghold-coupons.com).

14. Advertising & Publicity
You shall not create, publish, distribute, or print any written material that refers to our Program without first submitting that material to us and receiving our prior written consent. If you intend to promote our Program via email campaigns, you must adhere to the following:

  1. Abide by the General Data Protection Regulation (GDPR) as well as any other relevant privacy and electronic communications laws applicable in Germany and the EU, including but not limited to the German Telemedia Act (TMG) and the Act Against Unfair Competition (UWG).
  2. Emails must be sent on your behalf and must not imply that the email is being sent on behalf of XTRONGHOLD.
  3. Emails must first be submitted to us for approval prior to being sent, or we must be sent a copy of the email.

15. Social Media

Promotion on Facebook, Twitter, and other social media platforms is permitted following these general guidelines:

  1. You are allowed to promote offers to your own lists; more specifically, you’re welcome to use your affiliate links on your own Facebook, Twitter, etc., pages. For example, you may post, “25% off sale at XTRONGHOLD through Wednesday with code XTRONGOLD25.”
  2. You ARE PROHIBITED from posting your affiliate links on XTRONGHOLD’s Facebook, Twitter, Pinterest, etc., company pages in an attempt to turn those links into affiliate sales.
  3. You ARE PROHIBITED from running Facebook ads using XTRONGHOLD’s trademarked company name.
  4. You ARE PROHIBITED from creating a social media account with XTRONGHOLD’s trademark in the page name and/or username.

16. Operations Outside of Germany

If you are conducting business in or taking orders from persons in other countries, you will follow the laws of those countries. For example, you will comply with the European Union’s Privacy and Electronic Communications Directive if you are conducting business in or taking orders from persons in one or more of the European Union countries.

17. Reversal & Communication Policy

We reserve the right to reverse orders or lead actions due to order cancellations, duplicate tracking, returns, disputed charges, suspected reseller activity, suspected fraudulent or illegal activity, and program violations as outlined in these terms and conditions. Additionally, if we ask you for clarification or more information on any orders, lead actions, or clicks that we suspect may be in violation of our terms and conditions, we expect that you will respond in a timely and honest manner. Below are violations of our communications policy:

  1. You are not forthcoming, intentionally vague, or found to be lying.
  2. You are not responsive within a reasonable time period and after multiple attempts to contact you with the information listed in your network profile.
  3. You cannot substantiate or validate the source of your traffic to our program with clear and demonstrable proof. If any of the above apply, then we reserve the absolute right to reverse orders, set your commission to 0%, or suspend you from the program for the period or orders in question. We know that many violations result from automated processes; however, it is incumbent upon each affiliate to ensure that they have the appropriate checks and balances in place to proactively address these issues and adhere to our program rules.

18. Termination

XTRD reserves the right to terminate any affiliate account at our discretion. Termination can occur for any reason, including, but not limited to, violation of these Terms & Conditions. Upon termination, you will forfeit any remaining commissions that have not yet been paid.

19. Limited Liability

To the fullest extent permitted by law, XTRONGHOLD GmbH shall not be liable for any indirect, special, incidental, consequential, or punitive damages arising out of or related to the XTRD Affiliate Program or these Terms & Conditions, even if we have been advised of the possibility of such damages. In no event shall XTRONGHOLD GmbH’s total liability exceed the amount of commissions paid to you in the three months preceding the event giving rise to the claim.

20. Modifications

XTRD reserves the right to modify these Terms & Conditions at any time. Affiliates will be notified of any changes, and continued participation in the program constitutes acceptance of the new terms.

22. Governing Law

The laws of Germany shall govern these Terms & Conditions.
